The pre-sale law of a building has been enacted with the focus on how to prepare a specific contract under the title of pre-sale contract of a building and the regulations surrounding it. The present article has analyzed and examined the explanation of the formal nature of the pre-sale contract of a building and its effects from a jurisprudential and legal perspective. Although this contract is jurisprudentially in the form of contracts of suspended contract, peace of istisna, total in the debt, not received, salm and mere sale, a non-named contract of a specific thing, and legally in the form of independent private contracts, sale, commitment to sell, promise to sell, consent, and a contractual ownership contract have also been discussed and examined in the thesis, and each of them has its merits, and other theories may be proposed in the analysis and explanation of the nature of the pre-sale contract of a building that can be examined from a jurisprudential and legal perspective..</p> <p>یکی از مسائل مهم قرارداد پیش فروش ساختمان تشریفاتی دانستن قرارداد پیش فروش ساختمان می باشد، به دلیل این که عدم رعایت تشریفات در عقود تشریفاتی مانع از شکل گیری قرارداد می گردد. قانون پیش فروش ساختمان، با محوریت نحوه تنظیم یک قرارداد خاص تحت عنوان قرارداد پیش فروش ساختمان و مقررات پیرامون آن وضع گردیده است. مقاله حاضر به تحلیل و بررسی تبیین ماهیّت تشریفاتی قرارداد پیش فروش ساختمان و آثار آن از منظر فقهی و حقوقی پرداخته است. هر چند این قرارداد به لحاظ فقهی در قالب عقدهای مُعلَّق، جعاله، صُلح، استصناع، کلی فی الذِمه، ما لم یقبض، سَلَم و صَرف، بیع عهدی بی نام، بیع عین معین. و به لحاظ حقوقی در قالب عقدهای خصوصی، مستقل، بیع، تعهد به بیع، قولنامه ( وعده به بیع )، رضایی، عهدی، تملیکی، پیمانکاری، نیز در رساله مطرح شده و مورد بررسی قرار گرفت و هر یک از آن ها دارای مُحَسناتی است. و ممکن است نظریات دیگری هم در تحلیل و تبیین ماهیّت قرارداد پیش فروش ساختمان طرح گردد که به لحاظ فقهی و حقوقی مورد بررسی قرار گیرد.</p> http://kalam.saminatech.ir/en/Article/Download/51293
